1. The service

Pollen Atlas (pollenatlas.com) is a free pollen count, air quality and weather information service operated by GigChampion LLC (“Pollen Atlas”, “we”, “us”). It publishes a Total Pollen Index, pollen forecasts and air-quality figures for cities across the United States, and a directory of allergists. By using the site, you accept these terms.

2. What the site is not

The pollen, air-quality and weather figures on Pollen Atlas are informational estimates drawn from third-party data sources. They are not medical advice, are not a diagnosis or a treatment recommendation, and are not a substitute for a clinician’s judgement. Decisions about medication, treatment and managing your allergies belong with you and your healthcare providers. If you are having severe symptoms — difficulty breathing, for example — seek medical care immediately rather than consulting a forecast.

3. Accounts

Allergist accounts are for healthcare providers listed in the directory, and practice staff acting on their behalf. When you register, you agree to provide accurate information and to keep it current. You are responsible for activity under your account and for keeping your credentials confidential. We may suspend or close accounts that are misused, that carry inaccurate listing information the account holder will not correct, or that breach these terms.

4. Acceptable use

You agree not to: scrape or harvest the site in a way that degrades the service for others; impersonate any person or practice; post unlawful, misleading or infringing content; interfere with other users’ listings or accounts; or attempt to gain unauthorised access to the site, its accounts or its data.

5. User content and listings

Content you provide — listing details, practice information, corrections — remains yours. You grant us the licence needed to display, format and distribute it as part of the directory and the site. You are responsible for the accuracy and legality of what you provide, and for having the right to provide it.

6. Intellectual property

The site’s content, data presentation, design and branding belong to us or our licensors. Content you provide remains yours, as described above. Nothing in these terms transfers ownership of either.

7. Third-party links and data sources

The site displays data from third-party sources and links to third-party websites. We are not responsible for third-party sites, their content, or their data practices; the Privacy Policy describes what we do with information on this site.

8. Availability and changes to the service

The service may change, be interrupted, or be withdrawn at any time without notice. Features described as planned or pre-launch are not promised and may never ship.

9. Limitation of liability and warranties

The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, and non-infringement. To the extent the law allows, our liability for any claim arising from use of the site is limited to the amount you paid to use it — which, for a free service, is zero — and we are not liable for indirect or consequential damages.

10. Governing law

These terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Disputes arising from these terms or the site will be resolved in the state or federal courts located in Arizona, unless applicable law gives you the right to bring a claim elsewhere.

11. Changes to these terms

Changes to these terms are posted on this page with a new date. Continued use of the site after a change is posted is acceptance of the updated terms.
